1. FILING FEES
 

 I. Matters where amounts involved for ARBITRATION are:

a) PHP	20,000.00	to	249,999.99	=	2,000.00
b) PHP	250,000.00	to	999,999.99	=	3,500.00
c) PHP	1,000,000.00	to	4,999,999.99	=	7,000.00
d) PHP	5,000,000.00	to	24,999,999.99	=	15,000.00
e) PHP	25,000,000.00	to	99,999,999.99	=	35,000.00
f) PHP	100,000,000.00	to	999,999,999.99	=	100,000.00
g) PHP	1 Billion	and	above	=	250,000.00

 II. Matters where amounts involved for MEDIATION are:

a) PHP	20,000.00	to	249,999.99	=	500.00
b) PHP	250,000.00	to	999,999.99	=	1,000.00
c) PHP	1,000,000.00	to	4,999,999.99	=	2,500.00
d) PHP	5,000,000.00	to	24,999,999.99	=	5,000.00
e) PHP	25,000,000.00	to	99,999,999.99	=	10,000.00
f) PHP	100,000,000.00	to	999,999,999.99	=	35,000.00
g) PHP	1 Billion	and	above	=	75,000.00

III. Matters for MEDIATION then ARBITRATION or ARBITRATION then MEDIATION

Computation follows filling fees set in I. and II. based on amounts resolved by the primary ADR mode utilized. Balance of amount remaining in unresolved portion shall be used as basis for filing fees for the succeeding ADR mode.

Should no balance amount remain but merely remedial, procedural, administrative or any other non-monetary issues remain, filing fees chargeable for the succeeding ADR mode follows level one grade lower than that applicable for the amounts that had actually been awarded and/or settled regardless of the original amount involved in the primary ADR mode used. E.G. f) level down to e); c) level down to b; etc. where the a) level is to be reduced by 40%

Note: In case matter is submitted for MEDIATION then ARBITRATION, Mediator will not be allowed to Arbitrate the same matter so parties need to nominate another Neutral for Arbitration.

It is advisable, to save on fees, to submit to MEDIATION then ARBITRATION than vice versa.

IV. Matters for CONCILIATION are [on per day (0 - 7 hrs) basis]:

Follows fees set in (II.) less Thirty Three (33%) percent.

V. Matters for FACILITATED SETTLEMENT NEGOTIATIONS

Follows fees set in (II.) less Forty (40%) percent.

VI. Matters for MINI-TRIALS

Follows filing fees set in I.

VII. Matters for EARLY NEUTRAL EVALUATION

Follows filing fees set in II. less Fifty (50%) percent.

NOTE ONE:

CASES, WHERE AMOUNTS INVOLVED ARE BELOW P20,00.00, WILL BE REDIRECTED TO EITHER CONCILIATION, MEDIATION OR FACILITATED SETTLEMENT NEGOTIATIONS - USE NEGOTIATED FEES.

NOTE TWO:

ALL FILING FEES NEEDS TO BE FULLY PAID WITHIN FIVE WORKING DAYS AFTER RECEIPT OF CONFIRMATION OF ACCEPTANCE BY NEUTRAL AND BY PHILIPPINE ADR PROVIDER INV. SCHEDULE WILL BE CANCELLED IF PAYMENT IS NOT RECEIVED BY THE SEVENTH DAY AND A CANCELLATION FEE/RESCHEDULING FEE OF P500 TO P5,000 MAY BE CHARGED AT THE OPTION OF PHILIPPINE ADR PROVIDER INC.

2. ASSISTANCE FEES

All below are exclusive of any government or court filing fees, if applicable.

• Confirmation of Award / Settlement Agreement - Once (1%) of value.
• Provisional Remedies Filing - Actial Transportation Cost Plus 25% of court filing fees.
• File Preparation / Clerical or Secretarial Assistance / Notice of Process Serving-Mailing
• Special Food Preparations

3. HEARING ROOM FEES (IF APPLICABLE):

P25 per sq. feet per day for PAP, Inc. owned facilities; or Actual amount charged by owner of facility plus Twenty (20%) Percent.

4. NEUTRAL FEES:

Netral Fees depends on experience and capability of neutral. It could range from:

5. STUDY TIME FEE:

This is the time spent by the neutral to go over the pleadings, briefs, evidences and the suggested laws submitted before the hearing. This includes the time spent by the neutral, If any is needed, to study the case after the hearing in order to resolve and/or decide on matters heard.

All fees stated above are Hearing Fees. Study Fees are 50% of Hearing Fees.

A Pre-Hearing Advance Deposit (PAD) of Two (2) Hour Study Fee and Two (2) Hour Hearing Fee shall be collected at least two (2) weeks before scheduled date of hearing. If no deposit is received by that time, hearing date is to be rescheduled only upon receipt of PAD but in no case shall delay in payment be more than (2) weeks after first scheduled hearing. Otherwise, parties will have to reaplly and pay another filing fee. The prior fee paid shall be forfeited to pay, among others, for all preparations made for the ADR proceedings.
